The www.jasonlee.co.za Website ("Site") is owned and operated by Jason Lee ("Jason Lee" or "We/our").

Membership

  1. General
    1. In order to improve your experience of the Site and for the Benefits of Membership, We encourage you to become a member of the Site ("Member"). If and when you decide to become a Member, you agree to (1) provide accurate, current, and complete information about yourself as prompted by the appropriate registration form, (2) maintain and update your information to keep it accurate, current, and complete, and (3) comply with the payment terms and Terms & Conditions of Use set out below.
    2. You may review, correct, change, or update your membership information by visiting the Members section of the Site.
    3. You agree that if any information provided by you is untrue, inaccurate, not current, or incomplete, We reserve the right, at our sole discretion, to suspend or terminate your membership.
    4. As part of the membership sign in process, you will be asked to select a membership name and password. You agree that:
      1. You may not choose a member name that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion.
      2. We reserve the right to reject any member name in Our sole discretion.
      3. If you have reason to believe that your password is no longer secure, you must promptly change your password by updating your membership information.
  2. Payment
    1. The annual fee for your Membership is R650 plus VAT (if applicable). You agree that by signing up to be a Member and providing your payment details, We shall be entitled to deduct the Membership fee plus VAT (if applicable) from your credit or debit card as provided.
    2. Membership fees are non-refundable.
    3. Membership fees will automatically be deducted from your credit or debit card as provided by you to Us on an annual basis. If you do not wish to continue being a Member of the Site, you must notify us by email at least two months prior to your desired cancellation date. Please note that if We do not receive adequate notice of your request to discontinue, you will be billed membership fees automatically each year.

    Terms and Conditions of Use

    By using the Site you agree to be legally bound by these terms, which shall take effect immediately on your first use of the Site. If you do not agree to be legally bound by all of these terms of use, please do not access and/or use the Site and discontinue browsing the Site.

    Jason Lee and / or his successors in title may change these terms of use at any time by posting changes online. Please review all these terms of use regularly to ensure you are aware of any changes made by Jason Lee and / or his successors in title. Your continued use of the Site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
    1. Rights, including Copyright
      1. All rights, including copyright and database rights, in the Site and its contents, are owned by or licensed to Jason Lee and / or his successors in title, or otherwise used by Jason Lee and / or his successors in title as permitted by applicable law. Jason Lee and/or his successors in title shall remain at all times the owner(s) of any and all copyrights, trade marks and other intellectual property rights in this Site and in the graphics, design, arrangement and look and feel of the Site. Further, Jason Lee and/or his successors in title (or their licensors) remain at all times the owner(s) of all material or content supplied to you as part of the Site.
      2. In accessing the Site, you agree that you will access its contents solely for your own private use but not for any commercial or public use. You can download and use the Site and its contents on a single PC at a time and you can print out a single hard copy of any part of the content on the Site for your personal use.
      3. Except as permitted above, you undertake not to copy, store in any medium (including in any other website), distribute, transmit, re-transmit, broadcast, modify, or show in public any part of the Site without the prior written permission of Jason Lee and / or his successors in title, or in accordance with applicable laws and regulations.
      4. The names, images and logos identifying Jason Lee and / or his successors in title or any associated companies or third parties (and their products and services) are proprietary marks of Jason Lee and/ or his successors in title (or of any associated companies and/or third parties).
    2. Terms of Use
      1. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content from the Site in any way except for your own personal, non-commercial use, or as otherwise stated by any terms applicable to any specific part of the Site.
      2. You also agree not to adapt, alter or create a derivative work from any content on the Site except for your own personal, non-commercial use. Any other use of content from the Site requires the prior written permission of Jason Lee and / or his successors in title.
      3. By accessing, using and/or downloading materials from this Site, you agree to adhere to and comply with all of the terms and conditions set out here and you also agree to do so on behalf of any other person or entity on whose behalf you may be acting.
      4. You agree to use the Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Site.
      5. You shall compensate Jason Lee and / or his successors in title for any expense, loss or damage We may suffer as a result of any claims and/or liabilities that may arise in any manner from your use of the Site other than in accordance with these terms of use.
    3. Disclaimers and Limitation of Liability
      1. This Site and the information, names, images, pictures, logos and icons relating to Jason Lee and/or his successors in title and/or any associated companies, products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis without any representation or endorsement being made and without warranty of any kind, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
      2. Under no circumstances will Jason Lee and / or his successors in title be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the Site regardless of the form of action.
      3. You acknowledge that any reliance on any such statement or information shall be at your sole risk. We reserve the right, in Our sole discretion, to correct any errors or omissions in any part of the Site and to make changes to the Site and to the materials, products, programs, services or prices described in the Site at any time without notice.
      4. You may find in the text and content and other materials included on this Site inaccuracies and typographical errors. We do not warrant the accuracy or completeness of the information and materials or the reliability of any statement or other information displayed or distributed through the Site (including, without limitation, the information provided through the use of any software). We make no representations or warranties as to the suitability, functionality, accuracy or reliability of any material made available to you.
      5. Jason Lee and / or his successors in title do not warrant that functions contained in the content of the Site will be uninterrupted or error free, that defects will be corrected, or that the Site is free of viruses or bugs.
      6. We may terminate, change, suspend or discontinue any aspect of this Site or any of its features at any time without notice or liability to you.
    4. Contributions to the Site
      1. Where you are invited to submit any contribution to the Site (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant Jason Lee and / or his successors in title a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in Jason Lee's Privacy Policy.
      2. If you do not want to grant to Jason Lee and / or his successors in title the rights set out above, please do not submit your contribution to the Site.
      3. In addition to the above, by submitting your contribution to Us, you represent and warrant to Us that your contribution is (1) your own original work and that you have the right to make it available to Us for all the purposes specified above; (2) is not defamatory; and (3) does not infringe any applicable law.
      4. You agree to indemnify Jason Lee and / or his successors in title against all legal fees, damages and other expenses that We may suffer or incur as a result of your breach of your representation and warranty above.
      5. By submitting your contribution to us you also agree to waive any moral rights in your contribution for the purposes of its submission to and publication on the Site and for the purposes specified above.
    5. Jason Lee Community Rules (if and when applicable)
      1. You agree to use the Members' Communities, Our Chat rooms and Discussion Forums, in accordance with the following Community Rules. These Rules apply across all Jason Lee community sites and services.
      2. About your posts:
        1. If a Member requests assistance we will always endeavour to respond to that individual request for assistance, but we cannot guarantee to do so.
        2. Contributions must be civil and tasteful. No disruptive, offensive or abusive behaviour will be permitted: contributions must be constructive and polite, not malicious mean-spirited or contributed with the intention of causing trouble.
        3. No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
        4. If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your Membership.
        5. No impersonation allowed.
        6. Be patient: users of all ages and abilities may be taking part in the relevant Jason Lee Community.
        7. No spamming or off-topic material: We do not allow the submission of the same or very similar contributions many times. Please do not re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
        8. No advertising allowed.
        9. Contributions containing languages other than English may be removed.
        10. No inappropriate (e.g. vulgar, offensive etc) user names permitted.
        11. You may not refer to specific URLs (web site addresses) unless allowed. If you know of a worthy website relevant to the discussion topic, please inform Us.
        12. Should a complaints facility be made available at any stage, its deliberate misuse of the complaints facility will not permitted. If you persist in doing this, action may be taken against your Membership.
          If you have any comments or requests in relation to Jason Lee please do not post them as messages but email the Webmaster who will endeavour to respond to any such email individually.

          13. Safety:

        13. We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, home address or email address), and please do not include postal addresses of any kind. If you have a helpful address to share, inform the host.

          14. About the law:

        14. You may not submit any defamatory or illegal material of any nature in Jason Lee Communities. This includes text, graphics, video, programs or audio.
        15. Contributing material with the intention of committing or promoting an illegal act is strictly prohibited.
        16. You agree to only submit materials which are your own original work. You must not violate, plagiarize, or infringe the rights of third parties including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights.
        17. The views and recommendations expressed in Jason Lee Community areas, or in the Q and A Directory, are those of members of the public and are not necessarily those of Jason Lee and / or his successors in title
